These Terms of Service (the “Terms”) govern your access to and use of the website located at purgexonline.com (the “Site”) and any related services, including text messaging, offered by Purgex, a brand of Neutrex, Inc. (“Purgex,” “we,” “us,” or “our”). By accessing or using the Site, requesting a sample or quote, or providing your contact information, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Purgex

Purgex manufactures and supplies commercial purging compounds for thermoplastic processing, including injection molding, extrusion, and blow molding. Information on the Site is provided for general business and technical reference. Product recommendations and processing guidance are general in nature and may not apply to every machine, resin, or process.

2. Eligibility

The Site and our services are intended for businesses and for individuals who are 18 years of age or older. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and current.

3. Use of the Site

5. Samples, Quotes, and Product Information

Sample requests, quotes, and product selections are offered to help you evaluate Purgex products for your specific application. Samples are provided for evaluation purposes. Pricing, availability, and specifications are subject to change and are confirmed at the time of order. Nothing on the Site constitutes a binding offer to sell.

6. SMS and Text Messaging Terms

These messaging terms apply to anyone who provides a mobile phone number and consents to receive text messages from Purgex. By opting in, you agree to the following.

Program description. Purgex sends text messages for customer care and account support. This includes responding to sample requests, answering product and application questions, coordinating quotes and orders, sending order and shipping updates, scheduling technical consultations, and following up on open support conversations. Messages are conversational and are sent by Purgex representatives.

Consent. You will only receive text messages from Purgex if you provide your mobile number and agree to receive them, either by checking the consent box on a form at purgexonline.com or by giving verbal or written consent to a Purgex representative during a sales or support conversation. Consent to receive text messages is not a condition of purchasing any product or service.

Message frequency. Message frequency varies based on your interactions with us.

Cost. Message and data rates may apply, depending on your mobile carrier and plan. Purgex does not charge for the messages, but your carrier rates still apply.

Opt out. You may opt out at any time by replying STOP to any message. After you reply STOP, we will send one confirmation message and will not send further texts under this program unless you opt in again.

Privacy of mobile data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt in data and consent are not shared with any third party except as needed to deliver the messaging service (for example, our messaging platform provider). Carrier liability. Mobile carriers are not liable for delayed or undelivered messages.

Supported carriers. Messaging is available on major United States mobile carriers. Carriers are not responsible for service interruptions.

7. Privacy

Your use of the Site and our messaging service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Site, you consent to the practices described in that policy.

8. Disclaimer of Warranties

The Site and its content are provided on an as is and as available basis. To the fullest extent permitted by law, Purgex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that technical guidance will produce a specific result in your operation. Product warranties, if any, are stated separately in the terms accompanying a confirmed order.

9. Limitation of Liability

To the fullest extent permitted by law, Purgex and Neutrex, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising out of or related to your use of the Site or our messaging service, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms will not exceed the amount you paid to us, if any, for the product or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Purgex, Neutrex, Inc., and their officers, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorney fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
